With any tax planning scheme, especially for trading companies, it is vital to show that there is a genuine 'permanent establishment' really doing the work that one would expect from the low tax jurisdiction. In today's world, it is absolutely not possible - even for relatively small trading companies - to employee nominee directors and really conduct the business back in the high tax country: to do so is not only illegal but to put it frankly quite silly as robust structures can be provided quite economically. However, for those unwise enough to run the gauntlet the consequence is that there will almost certainly be a 'boomerang' effect back to the high tax country resulting not just in penalties but potentially criminal action.
